Debt Collection and Garnishments
Pursuing or defending wage garnishments in the state of Florida is a complex process. You need an attorney who is resourceful in his or her handling of cases and knowledgeable about Florida law. Strict procedures must be followed.
Following the filing of a lawsuit over an unpaid debt and securing of a judgment from the court, a creditor can move forward with a wage garnishment. However, steps can be taken by the garnishee in stopping further collection actions. Garnishments can leave individuals without necessary finances to pay mortgages, rent, utilities and even groceries.
State and federal laws may provide protection to them in the form of exemptions, an alternative to filing bankruptcy. However, exemptions to garnishments do not erase the debt owed.
